Job overview

The Trust has an established Wholly Owned Subsidiary, Gloucestershire Managed Services (GMS Limited), which manages estates and facilities for the Trusts. The Head of Contract Compliance is members of the Gloucestershire Hospitals NHS Foundation Trust management team to ensure its service requirements are articulated, understood and delivered through GMS. 

To be the professional lead responsible for contract management and compliance reporting to the Portfolio Director for Estates & Facilities. To manage specialist contracts and projects as delegated including Trust, ICS, Department of Health (DoH) acting as Trust lead in all estates related contractual negotiations, which may include specialist HR discussions, and liaison with national heads of service including Regional & National NHS teams. 

 Key contracts include:

- Gloucestershire Managed Services (GMS) Limited – wholly owned subsidiary managing the Trust’s Estates and Facilities functions

- Gloucestershire Health Partnership (GHP) – PFI Contract 

- SABA – Car parking provider

- Sovereign housing – Accommodation provider

Main duties of the job

- To be the professional & technical lead for the Trust on all contractual matters relating to estates and facilities, including performance reporting for: -

Gloucestershire Managed Services (sub-co)

Gloucestershire Health Partnership (GHP) which is managed through Avison Young with an estates management company (Apleona).  This is the PFI estate.

Saba (Car Parking, including the management of a multi-storey car park)

Sovereign housing (accommodation provided to Trust key worker staff)

Detailed job description and main responsibilities

- To manage these specialist contracts, leading the Trust response on contractual, commercial and legal matters.

- Budgetary management on related invoicing and payments associated with the above contracts and related items

- Financial forecasting and monitoring of the Trusts Estates contracts in association with the Trust’s Finance Department to ensure best value for money across the Estates Contracts portfolio

- Management of the Trust terrier for leased buildings, stating the responsibilities required by GMS and other organisations involved as landlord and lessee

- Provide support to the Contract Management Group (CMG) for the management of the Estates Contracts portfolio

- To advise the Trust on contract variations both required from the Trust and from the contractors in response to amendments in national, statutory or strategic direction.

- To support in planning for the PFI concession agreement expiry, including the need to ensure the ongoing service provision, ensuring best value for the Trust, minimising risk, and determining that performance standards are continually met. 

- To provide & receive complex information by analysing & exchanging technical, commercial and legal information with specialist legal teams, consultants & suppliers; negotiating to ensure maximum value.

- To provide close & regular liaison with contract providers on all estate & facilities related operational, technical, contractual & performance matters.

- To support with Trust benchmarking activity, responsible for agreeing Terms of Reference, and KPIs with stakeholders and specialist advisors, to demonstrate value for money and increased performance.

- To ensure clear systems are in place with contract providers to carry out comprehensive cyclical condition surveys, risk assessments and audits to monitor the service performance, and managing action plans to improve contract breaches, service failures and non-compliance.

- Responsible for all financial, contract, business and performance aspects of the estate contracts, ensuring that services are delivered within set budgets, managing and minimising financial & performance risk.

- To ensure expenditure is delivered within concession agreements and plans, reviewing & analysing highly technical or complex information, negotiating with THC and SPV, and specialist advisors and suppliers to ensure best value.

- To chair contractual and project meetings for specialist areas of expertise, and to participate in and chair meetings on behalf of the Portfolio Director for estates and Facilities as delegated

- To implement robust governance processes for estates contracts, to ensure issues are escalated appropriately, and risks managed and escalated effectively.

- To actively contribute to the development & delivery of key policies, strategies and annual plans to improve contract efficiency and value for money.

- To report on estate contract issues, providing expert advice and recommendations based on the analysis and interpretation of complex information in line with legal requirements and the priorities of the Trust.

- To deputise for the Portfolio Director on estates matters, including line management of other senior managers, during times of annual leave, etc. as delegated.

Person specification

Qualifications & Experience

Essential criteria
  • Degree or equivalent knowledge and experience
  • In-depth managerial, financial and contracting knowledge
  • Evidence of Continuing Professional Development
  • Experience of working in an Estates & Facilities Management setting in a senior role
  • Managing Private Finance Initiative (or similar) complex FM contracts
  • Responsibility for the preparation & presentation of reports.
  • Significant previous experience of contract management
  • Experience of managing budgets and meeting cost improvement targets
  • Experience of interpreting complex legal contracts
  • Experience of managing a team of staff across a number of disciplines.
  • Highly developed leadership skills with the ability to motivate and inspire others
Desirable criteria
  • Professional membership of an engineering or building related FM professional institution such as IWFM or equivalent or other equivalent institution or substantial experience in estates and FM services
  • Experience of managing a PFI contract in an acute hospital setting
  • Experience of managing a variety of operational and life cycle projects
  • Good understanding of contractual requirements of relevant to PFI contracts, concession agreements, and facilities management services
  • Able to recognise and implement opportunities for service improvement and efficiency
  • Able to communicate highly technical and/or highly contentious matters to all levels of staff and contractors/service providers.
